2007 Ultimate Air Show Experience Contest: "See it here... See it there..." Official Contest Rules
These Official Contest Rules apply to the Ultimate Air Show Experience Contest: "See it here... See it there" to be held from July 9 through July 26, 2007 at participating Washington KeyBank locations. Official drawing to take place on July 27, 2007 (the "Contest"). Prize: Seafair will award one prize, consisting of the following experience package: SEATTLE AIR SHOW EXPERIENCE
** VIP event experiences are exclusive and not for sale at retail value. Odds of winning are dependant on the number of entries received. All Federal, State and local taxes are the sole responsibility of the winner. Prize may be substituted at the sole discretion of Seafair. Winner is responsible for all transportation to prize award locations; date and time specified by Seafair and the Indianapolis Air Show. Eligibility: Must be US Resident, 18 years or older, to enter or win a prize. This promotion is offered in the United States only and shall only be construed and evaluated according to U.S. law. Do not complete entry if you are not located in the U.S. Employees of KeyBank, Seafair, the Indianapolis Air Show, their affiliates, or their respective advertising, public relations, accounting or legal firms, and immediate family members or individuals living in the same household of such employees, are not eligible to enter the Contest or win a prize. For purposes of these eligibility rules, "immediate family members" mean spouse, children, parents, parents of spouse, siblings, and spouse's siblings. Additional Eligibility Requirements: Because of the nature of the prize, some restrictions may apply. How to Obtain an Entry Form: Entry forms will be available at participating Washington KeyBank Branch locations, during normal business hours from July 9 through noon on July 26, 2007. Submitting Your Entry Form: Complete the entry form and submit it at the KeyBank Branch location. All entries must be received by KeyBank by noon on Thursday, July 26, 2007. No mechanical or other reproductions of entry forms will be accepted. All entries become the property of Seafair and will not be returned. Neither KeyBank nor Seafair will not be responsible for entries that are lost, late, misdirected, illegible, destroyed, mailed, or that are incomplete. One entry per person. Selection of Winners: On July 26, 2007, a Seafair representative will select the winner by a random drawing from all eligible entry forms received by KeyBank prior to the deadline for receipt of entry forms noted above. You need not be present to win the contest drawing. The winner will be notified by telephone by Seafair. If Seafair determines that the person whose name was drawn was not eligible to enter the drawing, or if the person drawn refuses to accept the prize or does not respond to notification to accept the prize within 24 hours of telephone call or voicemail to notify them, or if the person whose name is drawn cannot be located using the information provided by the person on the entry form, Seafair will conduct a subsequent random drawing from all remaining eligible entry forms to select an alternate winner. Additional Agreements/Waivers: By entering the Contest, each entrant agrees (a) to be bound by these Official Contest Rules and to interpretation of these rules by KeyBank and Seafair and (b) that KeyBank and Seafair and their agents, affiliates, representatives and employees will have no liability whatsoever for any injuries, losses or damages of any kind resulting from acceptance or use of the prize(s). Except as prohibited by law, each winner also consents, by entering the Contest and without further compensation, to KeyBank or Seafair’s use and publication of the winner’s name, photograph, likeness, biographical information, and details of winning for KeyBank and Seafair’s advertising, promotional, or regulatory purposes. Contest void where prohibited by law. Force Majeure: Neither party shall be deemed in default hereunder and neither shall be liable to the other if either is substantially unable to perform its obligations hereunder by reason of any fire, earthquake, flood, tsunami, hurricane, epidemic, accident, explosion, strike, riot, civil disturbance, act of public enemy, embargo, war, military necessity or operations, act of God, any municipal county, state or national ordinance or law, any executive or judicial order, or similar event beyond such party’s control; provided, however, that no party shall be entitled to relief under this Section unless such party shall have given the other party reasonable notice of such event and shall have exhausted all reasonable means of complying or implementing alternative means of compliance with its contractual obligations hereunder.
